Terms & Conditions

“BuildMapper System” means the web application, mobile progressive web app (PWA), APIs, AI features (including Scout), permit database, and all associated services operated by BuildMapper at buildmapper.tech and related domains.

“BuildMapper Trusted User Identification” means the identification name(s), number(s) and/or password(s) provided by BuildMapper to a User to access the BuildMapper Systems under a User Account.

“User Account” means an account established by BuildMapper for a User.

“Website” means the websites located at www.buildmapper.com and buildmapper.tech, operated by BuildMapper.

The BuildMapper System is proprietary to BuildMapper. Subject to your acceptance of this Agreement, BuildMapper grants you a non-transferable, non-exclusive, limited license to use the BuildMapper System for your bona fide internal business purposes, with no right to sublicense.

BuildMapper reserves all rights not explicitly granted herein. You shall not:

• Copy, republish, or distribute the BuildMapper System except as expressly permitted under this Agreement
• Loan, sell, rent, lease, sublicense, or otherwise attempt to transfer your license to the BuildMapper System
• Use the BuildMapper System in a Service Bureau manner or permit third parties to access the system to process their own data
• Attempt to rewrite, reverse engineer, decompile, disassemble, or create derivative works of the BuildMapper System
• Remove, alter, or modify any proprietary notices or labels from the BuildMapper System
• Use the BuildMapper System to build a competing product or service

You acknowledge that this Agreement does not grant any rights to use the trade-marks or trade names of BuildMapper or their licensors. All such marks shall remain the property of their respective owners.

You agree to provide BuildMapper with accurate and complete information as required to complete your User Profile, and to notify BuildMapper of any change in such information or of any misuse of your credentials within ten (10) days of such changes becoming known to you.

You are responsible for maintaining the confidentiality of your password and account credentials. You agree to:

• Maintain, in strict confidence, any password that limits access to the BuildMapper System
• Ensure the BuildMapper System is turned off when not in use
• Notify BuildMapper immediately of any unauthorized use of your account
• Not share your credentials with any other person or entity

BuildMapper may, in its sole discretion, refuse to establish a User Profile, or cancel or suspend your account if BuildMapper reasonably believes the system has been or may be misused.

The BuildMapper System includes AI-powered features (“Scout”) that provide lead scoring, opportunity analysis, contact enrichment, email drafting, and market intelligence. You acknowledge and agree that:

• All AI-generated content is informational only and does not constitute professional business, legal, or financial advice
• Scout’s opportunity scores and recommendations are probabilistic estimates, not guarantees of business outcomes
• Email drafts and outreach suggestions generated by Scout must be reviewed and approved by you before sending
• BuildMapper is not liable for any business decisions made based on AI-generated recommendations
• AI models may occasionally produce inaccurate or incomplete information — always verify critical data independently

The BuildMapper System provides access to permit data sourced from public municipal and government records across British Columbia, Alberta, Ontario, and other jurisdictions. You acknowledge and agree that:

• Permit data is sourced from third-party public records and may not reflect the most current status of any permit or project
• BuildMapper does not warrant the accuracy, completeness, or timeliness of any permit information
• Contact information associated with permits (contractor names, phone numbers, emails) is sourced from public filings and may be outdated
• You are solely responsible for independently verifying permit data before relying on it for business decisions
• BuildMapper is not liable for any loss or damages arising from inaccurate or incomplete permit data

The BuildMapper System integrates with third-party platforms to enhance functionality. By enabling these integrations, you agree to the respective terms of each provider:

• Google OAuth & Gmail: Governed by Google’s Terms of Service and Privacy Policy. Gmail read-only access is used solely for contact and relationship intelligence features
• Microsoft / Entra ID: Governed by Microsoft’s Terms of Service
• HubSpot: Governed by HubSpot’s Terms of Service. Contact sync requires a valid HubSpot account
• Twilio (WhatsApp notifications): Governed by Twilio’s Terms of Service
• Tavily (web search): Used internally for external lead discovery; not user-facing

BuildMapper is not responsible for the availability, accuracy, or practices of any third-party integration. You may disconnect integrations at any time from your Profile settings.

The BuildMapper System is delivered as a Progressive Web App (PWA) accessible on mobile and desktop devices. By using the mobile application, you acknowledge that:

• Location access (GPS) may be requested for proximity-based lead scoring; this permission can be revoked at any time in your device settings
• Contact access may be requested for relationship intelligence features; BuildMapper only reads, never modifies, your device contacts
• Push notifications may be enabled for lead alerts and morning briefs; you can disable these at any time
• The PWA may store data in your browser’s local storage for offline access and session persistence

Access to the BuildMapper System may require a paid subscription. Fees are due on a monthly recurring basis. By subscribing, you agree that:

• Subscription fees will be charged to your payment method on a recurring monthly basis
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• BuildMapper reserves the right to suspend access for non-payment
• All fees are non-refundable except where required by applicable law
• BuildMapper may change subscription pricing with 30 days’ written notice

BuildMapper shall:

• Upon receipt of satisfactory User information, establish a User Account and provide access credentials
• Provide the User with information from time to time regarding the BuildMapper System and updates
• Subject to the terms of this Agreement, protect any information that the User provides in a manner consistent with applicable legislation and BuildMapper’s Privacy Policy

BuildMapper may store data and records generated by Users on the BuildMapper System. Notwithstanding the foregoing, you are responsible for all data and records generated by you, including backup and storage of such data. BuildMapper shall not be responsible for any lost or corrupted data.

BuildMapper disclaims any and all representations and warranties with respect to the BuildMapper System, either express or implied, including but not limited to third-party infringement, implied warranties of merchantability, and fitness for a particular purpose. The BuildMapper System is provided on an “as is” basis.

In no event shall BuildMapper be liable for any damages suffered or incurred by the User or any other person, including any special, incidental, indirect, direct, punitive, or consequential damages (including loss of business profits, loss of revenue, business interruption, or loss of business information) arising out of the use of or inability to use the BuildMapper System.

If you are dissatisfied with the BuildMapper System, your sole remedy shall be to terminate this Agreement.

You shall defend, indemnify, and save BuildMapper and its respective directors, officers, employees, agents, affiliates, and shareholders harmless from any claims, costs, damages, expenses, losses, and liability arising out of or relating to your use of the BuildMapper System, any breach of your obligations under this Agreement, or any misuse of your account credentials.

BuildMapper is not responsible for the contents of any third-party sites or services. BuildMapper provides links and access to third-party sites and services only as a convenience; their inclusion does not imply endorsement by BuildMapper.

BuildMapper may modify the terms and conditions of this Agreement in its sole discretion at any time by posting a revised version on the Website. Your continued use of the BuildMapper System shall constitute acceptance of any such modified terms.

Either party may terminate this Agreement immediately for any reason by providing written notice. Upon termination, you shall immediately cease use of the BuildMapper System and destroy any copies in your possession.

This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein. The parties agree that the Courts of the Province of British Columbia shall have exclusive jurisdiction over any dispute arising under this Agreement.

If a court of competent jurisdiction concludes that any provision of this Agreement is illegal, invalid, or unenforceable, then it shall be severed from this Agreement and the remaining provisions shall remain in full force and effect.

This Agreement constitutes the entire understanding between the parties and supersedes all previous communications, representations, and understandings, oral or written, with respect to the subject matter of this Agreement.
